MensRelief (“us”, “we”, or “MensRelief”, which also includes its affiliates) is the author and publisher of the internet resource lp.mensrelief.com (“Website”) on the world wide web as well as the software and applications provided by MensRelief, including but not limited to the mobile applications, the software and applications (together with the Website, referred to as the “Services”).
  2. This privacy policy (“Privacy Policy”) explains how we collect, use, share, disclose and protect Personal Information about the Users of the Services, including the Practitioners (as defined in the Terms of Use, which may be accessed via the following weblink lp.mensrelief.com (the “Terms of Use”), the End-Users (as defined in the Terms of Use), and the visitors of Website (jointly and severally referred to as “you” or “Users” in this Privacy Policy).
  3. This Privacy Policy has been created to demonstrate our commitment to the protection of your privacy and your personal information. Your use of and access to the Services is subject to this Privacy Policy and our Terms of Use.
  4. This Privacy Policy (“Policy”) is made, and hosted in accordance with the following Laws,
    a. The Information Technology Act, 2000
    b. Rule 3(1)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021;
    c. Rule 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (“SPI Rules”)

By accessing and/or using the services or by otherwise giving us their information, the Users will be deemed to have read, understood and agreed to the practices and policies outlined in this Privacy Policy and agree to be bound by the Privacy Policy. Usage of any of the services provided by us would be construed as a consent to our collection, use and sharing, disclosure of the User’s information as described in this privacy policy.
  6. Occasionally, at our discretion, we may include or offer third party products or services along with our services and products. These third-party sites have separate and independent privacy policies. We, therefore, have no responsibility or liability for the content and activities of these linked third parties. Nonetheless, we seek to protect the integrity of our services and welcome any feedback about these.
  7. Notwithstanding anything contained herein or the Terms of Use, we reserve the right to change, modify, add or delete portions of the terms of this Privacy Policy, at our sole discretion, at any time.
  8. If the User does not agree with this Privacy Policy at any time, the User may choose to not use any of the services or give us any of your information. If the User avails the services on behalf of someone else (such as a child) or an entity (such as your employer), the User represents that they are authorized by such individual or entity or the lawful guardian competent to

    (ii) consent on behalf of such individual or entity to our collection, use and disclosure of such individual’s or entity’s information as described in this privacy policy.

USER INFORMATION

  1. ‘User information’ for the purpose of this Policy includes the User’s personally identifiable information including but not limited to name, email address, residential address, phone number, photograph, identity and address proof and other information collected by MensRelief to provide its Services/Products to the User.
  2. User(s) have the option not to provide any information if they do not intend to avail any Service/Product. If any User(s) are providing information on behalf of any legal entity or third party, such User(s) should be authorized to provide the information.
  3. The information provided by the User and collected by MensRelief may include Identity Details, Contact Details, Personal Health Information (PHI), Personal Data, Sensitive Personal Data, Technical Information (such as IP address etc), Security Details (such as User Name, Password), Other Details (as may be required for providing the Services).
  4. We do not share any Identifiable Personal Information with any individuals, organizations and other companies. User(s) information is securely stored and utmost confidentiality is maintained and may be accessed/used/disseminated by us as per the terms specified herein. Without prejudice to the generality of the above, information collected by us from the User/you may include (but is not limited to) the following:
    a. contact data (such as your email address and phone number);
    b. demographic data (such as your gender, your date of birth and your pin code);
    c. data regarding your usage of the services and history of the appointments made by or with you through the use of Services;
    d. other information that you voluntarily choose to provide to us (such as information shared by you with us through emails).
  5. The information collected from you by MensRelief may constitute ‘personal information’ or ‘sensitive personal data or information’ under the SPI Rules. “Personal Information” is defined under the SPI Rules to mean any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, is capable of identifying such person.
  6. The SPI Rules further define “Sensitive Personal Data or Information” of a person to mean personal information about that person relating to:
    a. passwords;
    b. financial information such as bank accounts, credit and debit card details or other payment instrument details;
    c. physical, physiological and mental health condition;
    d. sexual orientation; medical records and history;
    e. biometric information;
    f. information received by body corporate under lawful contract or otherwise;
    g. visitor details as provided at the time of registration or thereafter; and
    h. call data records.
    MensRelief may collect any or all of the information listed above for providing Services to the User.
  7. MensRelief does not disclose/share any information collected from the User/you information to/with any third party service providers, save and except those mentioned in this Privacy Policy and, in accordance with its Privacy Policy or as per procedure prescribed by law, or in compliance with legal obligations.
  8. The Information provided by User(s)/you and collected by MensRelief may be accessed/used/disseminated for the following purposes and the User(s) explicitly consent to the same:
    a. Communicating with the User(s)
    b. Providing the Services contemplated under this Digital Platform
    c. Improving its Services
    d. Offering new Services
    e. Analytical purposes in anonymous form or as de-identified data and for this purpose we may take assistance of our affiliates and trusted business partners in India or Outside India for research, development, studies, betterment of services, understanding the User(s) Experience, serving the individual needs of the User(s) and improving the overall health delivery services/health outcome of the User(s). MensRelief may disclose aggregated information, but it will never contain Information that will identify a single User.
    f. Obtaining feedback
    g. For conducting Audit(s)/Review
    h. Record their telephonic, Video and chat conversations and/or consultations during their interaction with HCPs and other support staff and MensRelief can use it for legal, training and quality purposes
    i. Customizing User(s) needs and send personalized communications
    j. To send messages including but not limited to emailers, bulk emailers, SMS etc intimating the User(s) about MensRelief’s healthcare services, healthcare packages, offers and other promotional content. These messages may be sent using various third-party service providers
  9. When User(s) interact with or respond to an email campaign shared by MensRelief, User(s) may be redirected to a third-party website(s). The third-party website may collect information about the User(s) device, browser, IP address, operating system, interaction with an email etc. The third-party websites may also use cookies or other tracking technologies to identify the behavioural pattern of the User(s).

SHARING OF INFORMATION COLLECTED FROM THE USER(S)/YOU

  1. Information including but not limited to contact details, email ID health information and such other information as may be required will be shared with Third Party Service Provider(s), retailers, logistics service providers, E-mail Service Providers and other providers for providing the Services for the User(s) pursuant to the User(s) requests, especially while facilitating the Pharmacy and Laboratory Services. Information is likely to be exchanged while fulfilling orders, delivering medicines, laboratory reports etc. and for sending communications on the Digital Platform and through e-mailers.
  2. User(s) Information/data/consultation transcripts and/or summary (including but not limited to telephonic, Video and chat conversations) that might be generated during their interaction with Healthcare Professionals (HCPs)/transactions on the Platform may be used by MensRelief or shared with Third Party(ies) for the purpose of (1) review with the intent of improving the overall quality of services and care, training of Healthcare Professionals, for providing enhanced consultation experience to User(s), (2) handling complaints, and (3) meeting the regulatory or statutory requirements. MensRelief assures that any information exchanged for the said purpose shall be subject to stringent confidentiality obligations imposed on Third Party(ies).
  3. User(s) Information/data in de identified form may be used by MensRelief or shared with Third Party(ies) either in India or outside India for analytical purposes and for improving User(s) experience and User(s) use of the Services.
  4. User(s) Information/Data may also be used for providing (a) assistance, (b) effective search results and links (including listings and paid services) and (c) customer experience/service. MensRelief assures that any information exchanged herein shall be in accordance with its Privacy Policy. MensRelief may share the information given by the User(s) if directed by any judicial or a statutory authority or against receipt of judicial or statutory order or to comply with applicable law. Please be assured that no such information will be provided to any Third Party for any commercial purpose in any such way which is contrary to the commitments made under the Privacy Policy.
  5. MensRelief may share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of these Terms and/or privacy policy, or as otherwise required law. In the event, if there is any information which has to be provided outside the scope of this Privacy Policy, a prior notification and request for consent /approval will be shared with the User(s).

DELETION OF DATA/INFORMATION SUPPLIED BY THE USER(S)/YOU

  1. Any data/information supplied by the User(s)/you and collected by us shall be securely stored for the duration required under applicable law. In the event any User(s)/you are deleting their account or a User account becomes inactive, the concerned User(s)/you shall have no access to the data/information supplied and collected by us and the same shall be deleted from our servers after the duration for which it is required to be stored.
  2. After User(s) create the account and if there is any change in the Information provided earlier, the User(s) can edit their profile and make necessary modifications. User(s) are solely responsible for the Information provided by them.

COOKIE POLICY

  1. Cookies are small pieces of text used to store information on web browsers. Cookies are used to store and receive identifiers and other information on computers, phones and other devices. Other technologies, including data we store on your web browser or device, identifiers associated with your device, and other software, are used for similar purposes.
  2. MensRelief’s Website and mobile application uses cookies to store certain data (that is not sensitive personal data or information) that is used to provide customized information when the User(s) or Unregistered User(s) returns to the Website. “Cookies” are used to store User(s) or Unregistered User(s) preferences and to track User(s) or Unregistered User(s) trends, so as to enhance their interactive experience and generally improve the website’s services to them. In the course of serving advertisements or optimizing services to its User(s), MensRelief may allow authorized third parties for analytical and statistical purposes and to place or recognize a unique cookie on the User’s or Unregistered User’s browser.

CREATION OF USER ACCOUNT ON BEHALF OF THIRD PARTY

  1. If any User(s) creates an account with MensRelief for and on behalf of any other Party/ third party (other than for his use) like their family member(s)/friend(s)/child/ such User(s) acknowledge that they are duly authorized by the other Party/third party to create an account with MensRelief by furnishing such details as may be required for availing the Services. In case any User(s) is/are creating account on behalf of a minor, such User(s) acknowledge that they are legally authorized to act on behalf of such minors. User(s) acknowledge that MensRelief shall in no case be held responsible/liable for any third party claims/damages if any arising from any action in this regard.

FINANCIAL INFORMATION

  1. For availing certain Services/Products the User(s) may be required to subscribe/purchase such Services by entering requisite payment details. The payment details are captured by third party service providers and the User(s) are advised to read the terms and conditions of such third party service providers before making any payment. For the purpose of this section it is clarified that MensRelief does not collect sensitive personal or security related information like passwords etc., which are totally under encryption. User(s) may note the Third Party Service Providers are not under the direction, supervision and control of MensRelief and MensRelief expressly disclaims any and all liabilities associated, therewith. User(s) are advised to note this while providing their personal or security related information.

THIRD PARTY LINKS

  1. MensRelief may provide certain of the Services contemplated under this Digital Platform directly by itself or through third party service providers (such as but not limited to laboratories, pharmacies and private ambulance services). The mobile Application and the Website may contain links of such third party service providers and their Digital Platform. MensRelief shall not in any way be responsible for the content, Terms of Use, Privacy Policy, the mode of operations of such third party service providers.
  2. User(s) may note the Third Party Service Providers are not under the direction, supervision and control of MensRelief and MensRelief expressly disclaims any and all liabilities associated, therewith. The User(s) are hereby advised to carefully read the Terms of Use and the Privacy Policy and other relevant documents of such third party service providers/websites as accessing such third party Digital Platform is at the sole risk of the User(s). User(s) may also note that the third party digital platform may collect various types of information of the User(s) and their behavioural patterns. MensRelief definitely conveys to the User(s) that it does not monitor or have any control over the affairs of such third party websites or the contents therein. User(s) are categorically advised to get in touch with the third party digital platform and seek information/clarification about their operations and functioning.

SECURITY AND RESTRICTIONS

  1. To protect your privacy and security, MensRelief takes steps to verify Users’ identity before granting Users access to accounts, or before Users can make corrections to their information. Users are advised to maintain a strong password to help ensure the security of user accounts and in the interest of the privacy of the Users, the only mandatory requirement to register with MensRelief would be an active contact number.
  2. MensRelief implements high standard security measures to protect User(s) Information from and against unauthorized access. To this effect, MensRelief uses certain, physical, managerial, technical and operational safeguards as per industry standards and established best practices to protect information of Users which is collected by MensRelief. Notwithstanding the above, User(s) may note that no online platform can fully eliminate the security risks. MensRelief shall take all possible measures to protect the date, security, confidentiality and integrity of the User(s) information from unauthorised access. User(s) may also note that internet where the Digital Platform is hosted is not completely a secure environment, therefore MensRelief does not warrant a 100% security of the User(s) Information/data from being hacked/misused/copied/used unauthorizedly and in such cases User(s) agree not to hold MensRelief responsible for any consequences arising therefrom.
  3. Notwithstanding anything contained in this Policy or elsewhere, MensRelief shall not be held responsible for any loss, damage or misuse of the User Information, if such loss, damage or misuse is attributable to a Force Majeure Event. A “Force Majeure Event” means any event that is beyond the reasonable control of MensRelief and includes, without limitation, fire, flood, explosion, acts of God, civil commotion, strikes, lock outs or industrial action of any kind, riots, insurrection, war, acts of government, power failure, sabotage, computer hacking, unauthorised access to computer data and storage device, system failure, virus, attacks, bugs, computer crashes, breach of security and encryption.

LIMITATION OF LIABILITY

  1. We do not guarantee an error-free performance under this Privacy Policy. We may not always anticipate, catch, avoid or mitigate an unintended privacy issue, despite our reasonable efforts to do so.
  2. Accordingly, we welcome your feedback regarding any privacy concerns that you may have, including how we can improve this Privacy Policy.
  3. We will use reasonable efforts to comply with this Privacy Policy and will take prompt corrective action when we learn of any failure to comply with it.
  4. We do not warrant that this Website and Services, it’s servers, or email sent by us or on our behalf are virus free. We will not be liable for any damages of any kind arising from the use of this Website and Services, including, but not limited to compensatory, direct, indirect, incidental, punitive, special and consequential damages, loss of data, goodwill, business opportunity, income or profit, loss of or damage to property and claims of third parties.
  5. In no event will we be liable for any damages whatsoever in an amount in excess of the amount received from the User in lieu of the Services provided through the Website.
  6. No warranty of any kind, implied, expressed or statutory, including but not limited to the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose and freedom from computer virus, is given with respect to the contents available through the Website or its links to other internet resources as may be available to you through the Website.
  7. We make no claims, promises or guarantees about the accuracy, completeness, or adequacy of the contents available through the Website and expressly disclaim liability for errors and omissions in the contents available through the Website.
  8. Reference on the Website to any specific commercial products, processes, or services, or the use of any trade, firm or corporation name is for the information and convenience of the public, and does not constitute endorsement, recommendation, or favouring by us.

GENERAL TERMS

  1. The User acknowledges that this Policy is to be read in conjunction with and shall be deemed to be part of MensRelief’s Terms of Use.
  2. The User Information resides in MensRelief’s cloud database or the database of a third party authorised by MensRelief to provide cloud database services for a certain period of time even after the User ceases to use or access the Digital Platform and in such cases MensRelief shall not be liable for any usage of the User Information after the User ceases to use or access the Digital Platform.
  3. The Users hereby agree, consent and acknowledge that User Information shared by them, collected or collated through the Digital Platform could be stored, processed and handled by MensRelief or through its trusted third party service providers as set out in this Privacy Policy.
  4. The User should be aware that the User Information or other data, the User provides to MensRelief for availing the services or transacting through MensRelief could be read, collected, or used by other users or third parties in which case the User Information might be used for sending messages or communications.
  5. If User(s) unsubscribe from the Services and again intends to avail/subscribe to the Services, he/she is authorizing MensRelief to send such information as may be required, including but not limited to SMS, emails for enabling the User(s) to continue to avail the Services. User(s) hereby explicitly consent and agree that any request pursuant to this clause will override any opt-out/ override any opt-out unsubscribe request given by them earlier.

GRIEVANCE OFFICER

GOVERNING LAW AND JURISDICTION

  1. The terms and conditions of this Policy shall be governed by Indian Laws and the courts at Delhi shall only have exclusive jurisdiction to resolve any disputes.
